Failure to comply with this notice constitutes an offence under Section 61 of the Forest and Rural Fire Act 1977. No resident of, or visitor to, the rural fire area administered by Auckland Council is permitted to light ANY fire in the open air unless a fire permit has been issued by a warranted officer of the Auckland Council. The following activities DO NOT require a permit during a restricted fire season: 1.A traditional cooking fire on private property, which is continuously supervised and conducted in a safe and considerate manner, that does not constitute a danger to any person or property by reason of its location, risk of spread, inadequate containment, prevailing wind or otherwise. 2.Approved portable gas fired cooking receptacles. The following activities ARE PROHIBITED by this restriction and PERMITS WILL NOT be issued for: 1.Open air solid fuelled cooking fires/ barbeques, braziers, chimeras or charcoal burners in public places and on foreshores. 2.Open top non type approved incinerators, solid fuelled cooking fires/barbeques, braziers, chimeras or charcoal burners when used in an inconsiderate manner on private land. Having considered these exceptions above every person commits an offence against the Forest and Rural Fires Act 1977 when they, without the authority of a Fire Permit, light any fire in the open air within the rural fire area of the Auckland Council, or cause or permit such a fire to be lit, during the period of the restricted fire season. Attention is also drawn to the fact that the holding of a Fire Permit does not exempt the holder from responsibility for any cost or damage caused by any fire lit by the holder or their agent should a fire constitute a nuisance or get out of control.
